These Terms govern your use of RisingAMP (the “Service”), operated by Opal SS Constructions Pty Ltd (ABN 32 162 378 190) (“RisingAMP”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
RisingAMP is software for tracking construction expenses, invoices, budgets, and jobs, and for related record keeping. We may add, change, or remove features over time.
2. Eligibility and accounts
You must be at least 18 years old and able to enter a binding agreement. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Tell us promptly at lalit@opalssconstructions.com.au if you suspect unauthorised access.
3. Your data and content
You own the data you enter into the Service, including your expenses, invoices, receipts, and business details. You grant us a limited licence to store and process that data only as needed to provide and improve the Service, as described in our Privacy Policy. You are responsible for the accuracy of the data you enter and for having the right to upload it.
You can export your data and can request deletion of your account at any time.
4. Not financial, tax, or legal advice
RisingAMP is a record-keeping and reporting tool. It is not accounting, bookkeeping, tax, or legal advice, and figures it displays (including totals, margins, and budget positions) are calculated from the data you enter. You remain solely responsible for your own financial, tax, and compliance records and for verifying any figure before relying on it. We recommend you confirm important numbers with your accountant.
5. Acceptable use
You agree not to misuse the Service, including by attempting to access other users’ data without authorisation, disrupting the Service, uploading unlawful content, or using it to break any law.
6. Fees
The Service may be offered free, in trial, or on a paid subscription. Where fees apply, they will be shown to you before you are charged. We will give reasonable notice of any change to fees for an existing subscription.
7. Availability and warranties
We work to keep the Service available and accurate, but we provide it “as is” and do not warrant that it will be uninterrupted, error free, or fit for a particular purpose, except to the extent the law does not allow such warranties to be excluded.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited as set out below.
9. Limitation of liability
To the maximum extent permitted by law, and subject to clause 8, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data, or goodwill. Our total liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or one hundred dollars if you have paid nothing.
10. Intellectual property
We own the Service, its software, and its branding. These Terms do not give you any rights in them except the right to use the Service as intended. You keep ownership of your own data and content.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if needed to protect the Service or other users, giving reasonable notice where practicable.
12. Changes to these Terms
We may update these Terms from time to time. We will post the updated version and change the “last updated” date. Continued use after changes means you accept them.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction.
